New Proposed Regulations On E-cigarette Industry A Step Forward, But Potentially Dangerous For Businesses

HONOLULU, April 30, 2014 /PRNewswire/ — VOLCANO Fine Electronic Cigarettes®, one of the nation's first electronic cigarette distributors and retailers, issued a response in connection to the Food & Drug Administration's (FDA) proposed deeming regulations for the electronic cigarette industry released April 24, 2014.

VOLCANO eCigs is pleased to the see that the FDA is taking measured steps in establishing sensible regulation for the electronic cigarette industry. Some of the proposed rules such as creating a federally mandated legal age requirement for purchase of 18 and over has been something the company has self mandated since its inception. More details are needed on the proposed rules creating manufacturing and labeling standards as well as required registrations.

"As it sits, the proposed set of regulations could significantly increase the retail cost of goods to consumers and remove many products and smaller sized companies from the market completely. However, we are happy to see an extended comment period in which we can voice our concerns over the proposed set of rules. With over 100 full time employees and 12 retail locations, we'll be watching and engaging in the process to ensure logical, safe, and pro-consumer regulations. Our main concern is whether or not the rules will ultimately be over-reaching or be measured in accordance to the overall economic and public health benefit these products bring," said Cory Smith, CEO and Co-Founder of VOLCANO eCigs.

"I think the main concern for all manufactures and retailers will be the application process and the cost companies will have to bear to get through it. The FDA's proposal will require that all electronic cigarette products introduced onto the market after February 2007 be registered with the FDA which equates to nearly 99% of all products currently on the market. In the interim though, the FDA is proposing to allow companies to conduct business as usual," Smith stated.

Similar application procedures for new tobacco products were widely criticized by a Government Accountability Office report (http://www.gao.gov/assets/660/657451.pdf). The report detailed extensive delays at the FDA Center for New Tobacco Products.
